These Terms of Service ("Terms") govern your use of tgbenefitsolutions.com and the services we provide through this website (the "Site"). The Site is operated by TG Benefit Solutions, LLC ("TG Benefit Solutions," "we," "us," or "our"). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

About us

TG Benefit Solutions is an independent insurance brokerage located at 521 Grant Ave, Suite D, Clay Center, KS 67432. Trisity Gurney is the owner and a licensed insurance producer in Kansas, Missouri, and Nebraska. We place individual and family health, dental, vision, Medicare, supplemental, and small group health insurance.

Information only; not a contract of insurance

Information on the Site is provided for general informational purposes only. Nothing on the Site is a contract of insurance, an offer to insure, a recommendation of any specific policy, or a guarantee of coverage. Plan descriptions, premiums, benefits, exclusions, limitations, and eligibility criteria are summarized for convenience and are governed solely by the terms of the policy issued by the insurance carrier. Coverage depends on individual underwriting and may vary by state, age, health status, household composition, income, and other factors.

No legal, tax, medical, or financial advice

Nothing on the Site is intended as legal, tax, medical, financial, or accounting advice. We are licensed to advise on insurance products only. Decisions about insurance should be based on a review of your specific situation with a licensed producer. Tax consequences of insurance purchases, subsidy calculations under the Affordable Care Act, and similar questions should be discussed with your tax advisor.

Independence and compensation

TG Benefit Solutions is an independent brokerage. We represent multiple insurance carriers and are not employed by or exclusively contracted to any single carrier. We are compensated by the carriers whose policies we place. We do not charge a separate fee to consumers for our brokerage services. Our compensation from carriers does not change the premium you pay. We will, on request, tell you what carriers we represent for the type of coverage you are shopping for.

Not affiliated with any government program

TG Benefit Solutions is a private business. We are not affiliated with, employed by, or endorsed by the federal Medicare program, the Centers for Medicare and Medicaid Services (CMS), the Health Insurance Marketplace, the Social Security Administration, or any state government. Information we share about government programs is provided as a courtesy and may not be complete or current. Medicare disclosure

We do not offer every Medicare plan available in your area. Any information we provide is limited to those plans we do offer in your area. Please contact Medicare.gov, 1-800-MEDICARE, or your local State Health Insurance Program (SHIP) to get information on all of your options.

Accuracy and currency of information

Insurance laws, regulations, plan designs, benefits, and rates change frequently and vary by state. We make reasonable efforts to keep information on the Site current, but we cannot and do not warrant that any specific page is accurate, complete, or up to date at any given moment. If a plan description, premium, or benefit on the Site differs from the carrier's official documents or the policy issued to you, the carrier's documents and the policy control.

Communications consent

By submitting a contact form, requesting a quote, or otherwise providing your contact information through the Site, you authorize TG Benefit Solutions to contact you at the phone number and email address you provide. This contact may include:

• Responses to your inquiry and follow-up to discuss insurance products and services.
• Reminders about open enrollment, the Medicare annual election period, and renewals.
• Updates about your application, policy, claims, and carrier notices.

Your consent to receive calls or text messages is not a condition of purchasing any insurance product. Standard message and data rates from your wireless carrier apply. You may ask us at any time, by phone, text, or email, to stop calling, texting, or emailing you, and we will stop.

Third-party content and links

The Site may link to carrier quote engines, enrollment platforms, Medicare.gov, Healthcare.gov, and other third-party sites and tools. We do not control these third-party services and are not responsible for their content, accuracy, privacy practices, or accessibility. When you use a linked service, you are subject to that service's own terms and privacy policy.

Quote and enrollment tools

Any quotes, premium estimates, or subsidy calculations generated on the Site or through a linked third-party tool are estimates only. Final premium and eligibility are determined by the carrier upon underwriting and, where applicable, by the Marketplace upon verification of income and household information. We are happy to walk through any quote with you in person, by phone, or by video to confirm the details before you enroll.

Intellectual property

All content on the Site, including text, graphics, logos, photographs, and the overall design, is the property of TG Benefit Solutions or its licensors and is protected by United States copyright, trademark, and other intellectual property laws. You may view, print, and share Site content for personal, non-commercial use. You may not copy, modify, distribute, sell, or republish Site content without our prior written permission.

Acceptable use

You agree not to use the Site to:

• Submit false, misleading, or fraudulent information.
• Impersonate another person or misrepresent your relationship with another person.
• Attempt to gain unauthorized access to the Site, our systems, or the accounts of any other user.
• Probe, scan, or test the Site for vulnerabilities or breach its security, including by introducing viruses or other malicious code.
• Scrape, harvest, or otherwise collect information from the Site by automated means.

To the fullest extent permitted by law, TG Benefit Solutions and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Site, even if we have been advised of the possibility of such damages. Nothing in these Terms limits any liability that cannot be limited under applicable law, including under federal or state insurance laws governing the handling of insurance transactions.

Indemnification

You agree to indemnify and hold harmless TG Benefit Solutions and its owners, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of any third party.

Governing law and dispute resolution

These Terms are governed by the laws of the State of Kansas, without regard to its conflict-of-law principles. Any dispute arising out of these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Clay County, Kansas, and you consent to the jurisdiction of those courts. Disputes arising out of the placement, administration, or servicing of a specific insurance policy are also subject to the insurance laws and regulations of the state in which the policy was issued and the state of the consumer's residence.

Severability and no waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to enforce that provision later.

Changes to these Terms

We may update these Terms from time to time. Updates will be posted on this page with a new effective date. Your continued use of the Site after the effective date of a revised version constitutes your acceptance of the revised Terms. If a change materially affects your rights, we will give reasonable notice (for example, by a banner on the Site) before the change takes effect.
